Unfortunately, llandlord-tenant disputes are  common in the rental process, and could often be avoided if both parties knew their rights and responsibilities. For many years, our landlord-tenant attorneys at Herndon, Coleman, Brading, & McKee, LLP, have represented clients in all types of landlord-tenant disputes, including drafting and updating leases, initiating and handling the eviction process for landlords, dealing with difficult tenants, and collecting unpaid rent and judgments. Our lawyers are experienced in helping landlords in all aspects of evictions, lease revisions and drafting, and rental property management, both commercial and residential.

Our attorneys keep up with the laws so that you don’t have to. For residential landlords, for example, the advent of the Uniform Residential Landlord and Tenant Act (URLTA) changed Tennessee’s existing landlord/tenant law in most large counties in the state. While some smaller East Tennessee counties are still governed by common law, larger counties (such as Washington and Sullivan) follow URLTA. At the same time, federal laws, such as the Fair Housing Act and Americans with Disabilities Act, affect all residential landlords nationwide.

More recently, the COVID Relief Act, eviction moratoriums, and Tennessee’s COVID-19 Rent Relief program affected Tennessee residential landlords’ ability to evict tenants and/or to collect rent. Our attorneys’ sound knowledge of current federal laws and of Tennessee law, including the URLTA has, time and again, benefited our clients both in and out of the courtroom.
